The University of North Carolina Charlotte is walking back its practice of allowing students to live in housing that aligns with their so-called gender identity in response to changes in federal guidance.<\/p>\n

While the UNC system mandates sex-segregated housing, UNC Charlotte and UNC Asheville carved out exceptions for students who identify as the opposite sex. UNC Charlotte is eliminating its trans exception to the sex-segregated housing policy in response to President Trump\u2019s January executive order directing all federally funded institutions to protect women and girls from male intrusion into their private spaces.<\/p>\n

\u201cSpecifically, the decision followed two federal developments in early 2025: a federal court vacated the 2024 Title IX rules, which had interpreted sex-based nondiscrimination protections to include gender identity, and Executive Order 14168 directed federal agencies, including the Department of Education, to interpret sex-based laws based on biological sex rather than gender identity,\u201d Christy Jackson, deputy chief communications officer for UNC Charlotte, told National Review<\/span> in a statement.<\/p>\n

The executive order, signed by President Donald Trump in January, recognizes only two sexes and establishes guidance for protecting and defending female-only spaces, specifically noting \u201c\u2018Sex\u2019 is not a synonym for and does not include the concept of \u2018gender identity.’\u201d<\/p>\n

As a recipient of federal funds, UNC Charlotte now requires all housing arrangements to be made in accordance with a student\u2019s biological sex.<\/p>\n

\u201cIn light of those changes, we could no longer continue offering this separate, specialized grouping option,\u201d Jackson said.<\/p>\n

The policy will go into effect this fall for the 2026-27 school year.<\/p>\n

While UNC Asheville has not eliminated its transgender housing exception in response to Trump\u2019s order, the school did begin requiring students to request a change to their legal sex within university records before being allowed to room with the opposite sex. In order to secure a change in the university records system, students must provide documents supporting their espoused gender identity, in the form of a passport, birth certificate, or drivers license, or a university \u201csex designation form,\u201d in which licensed health provider attests to a student\u2019s gender identity.<\/p>\n

UNC Charlotte is one of several schools that in recent years began allowing students to room with peers who shared their so-called gender identity, rather than their sex.<\/p>\n

Towson University\u2019s housing policy, for example, explicitly states that \u201cstudents can be assigned to live in the same room with any other student regardless of legal sex, gender identity, gender expression, or sexual orientation.\u201d<\/p>\n

American University offers a similar option, called \u201cAll-Gender Housing,\u201d where students can be assigned roommates \u201cregardless of legal sex on file, gender identity, or gender expression.\u201d American University notes that this option is available across all residence halls, regardless of floor, except for female-only spaces on campus. Only students who opt-in to the program will participate.<\/p>\n

Portland State University also maintains its all gender housing, noting the program is facilitated through roommate matching, meaning a student can live with a student of any other gender. On the roommate pairing form, students have the option to choose between nine genders, as well as select which genders they are comfortable living with.<\/p>\n

These three institutions have not publicly signaled any shift in policy in light of the January 2025 executive order.<\/p>\n

Other institutions have dissolved their policies giving preference to gender identity, per both state and federal guidelines.<\/p>\n

The University of Kentucky ended its \u201cgender-inclusive housing\u201d program last October, following a House bill that prohibits special treatment in postsecondary education on the basis of diversity, equity, and inclusion.<\/p>\n

Institutions receiving federal funding that refuse to operate based on sex as an \u201cimmutable biological classification\u201d could potentially lose federal funding.<\/p>\n

Executive Order 14168, along with this recent shift in higher education to distinguish between biological sex in student housing, also requires government documents like passports to represent a person\u2019s biological sex. Single-sex rape shelters, bathrooms, prisons, for example, must adhere to the executive order.<\/p>\n
